I’ve had a trip / slip / fall accident in a supermarket / shop / on a road / path / at work / on a night out / in private / public premises – can I make a claim for compensation?
A trip, slip or fall is a very common type of accident. They can happen anywhere, anytime and to anyone and they can cause serious injuries and lead to significant financial losses. If you’ve suffered a trip, slip or fall accident and suffered injuries, even if they are relatively minor injuries, you may be able to make a claim for compensation.
The claim can be a relatively straightforward and quick process, but it can also be a complex claim to make. However, there is no automatic right to claim compensation following a trip, slip or fall accident. To make a claim for compensation for injuries (and your financial losses), you must prove three things:
- You were owed a duty of care;
- The duty of care has been breached i.e. broken;
- You have suffered a loss as a result of this breach of duty.
If you’ve had a trip, slip or fall accident and you had a legitimate and valid reason to be in the place where the accident took place, then the owner of (or the person responsible for the maintenance and upkeep of) that location owes you a duty of care to keep you safe. For example, this will be the local Council in the case of pavements, paths and roads, your employer in the case of a workplace accident or the supermarket or shop owner in the case of an accident in these premises.
If that location is not safe for you to use i.e. there is a tripping, slipping or falling hazard, then that duty of care may have been breached.
If you have suffered injuries as a result of this breach of duty, then you are likely to be able to make a claim for compensation.
