Facial scarring, psychological injuries and soft-tissue injuries
Our client was stationary at a T-Junction waiting to turn onto the main road. A car collided with the rear of our client’s car, shunting it onto the main road and into the path of another car. The driver that caused the collision i.e. the driver that hit our client’s car in the rear, drove off from the scene without providing insurance or contact details.
As a result of the collision, our client suffered significant facial scarring, psychological injuries and soft-tissue injuries. Our client also suffered financial losses and her car was a write-off.
Leech & Co arranged an inspection of our client’s vehicle and obtained the total loss cheque from her insurer. Leech & Co also arranged for our client to be provided with a replacement vehicle while she waited for the total loss cheque.
Leech & Co made all necessary investigations with the Police, our client’s insurer and the insurer of the vehicle our client was shunted into, but the driver that caused the accident could not be traced. Therefore, Leech & Co submitted the case to the Motor Insurer’s Bureau to be dealt with under the Untraced Driver’s Agreement.
While the MIB investigated the case, Leech & Co obtained our client’s medical records and obtained a medical report from an independent medical expert to document the injuries resulting from the accident.
The medical evidence in support of the claim included reports from two plastic surgeons, a Psychiatrist and a GP. The evidence confirmed our client had suffered the following injuries as a result of the accident:
- Soft-tissue injuries to the neck, back, chest and right arm, foot, wrist and ankle;
- A Psychiatric Disorder for which the Claimant needed treatment and which lasted for several years;
- Facial scarring which required treatment, but which will be permanent.
Leech & Co advised our client throughout the case in relation to the medical evidence, the further evidence required to support it and the value of the claim on the basis of the evidence.
Leech & Co also prepared a statement for our client to detail and describe the effects of the injuries and the accident on her life.
On the basis of the evidence, Leech & Co were able to negotiate with the MIB a settlement to the claim for the sum of £30,000.00. This sum was net of the cost of treatment provided to our client.
