How long does it take to run a claim to the end? How long will it be before I receive my compensation?
This is a difficult question to answer accurately because all claims will be different.
A straightforward claim with one medical report, one course of medical treatment and where court proceedings are not issued can be finished within approximately 6 months after the accident.
However, a more complex case involving multiple medical reports [need link to answer below], various courses of medical treatments and significant financial losses can take many months, if not a couple of years, to conclude successfully.
A case for compensation following an accident cannot be dealt with too quickly, even for a straightforward injury. This is because time must be taken to allow the injuries to settle a little before the examination with the medical expert. For example, if the medical expert examined a Claimant 2 weeks after the accident, the medical expert is unlikely to be able to confirm at that time when the Claimant is likely to recover because the injuries will not have settled following the accident. If this happens, a re-examination will have to be arranged which may delay the claim anyway. Therefore, it is better to wait for a few months before being examined so that the medical expert can assess the rate of recovery at that time and provide a full assessment of when the injuries will fully recover.
A claim for compensation can be settled at any time when there is a medical report detailing the injuries. However, it is always better to wait until all of the evidence is obtained, for example if the medical expert recommends obtaining another medical report, before trying to settle the case to ensure that you receive the maximum compensation to which you are entitled. If you settle the case before the evidence is complete, you risk settling the case for too little compensation.
Your personal injury solicitor will advise you throughout the claim about the medical evidence, the potential value of the claim and the steps needed to conclude the claim. You will then be able to assess with your Solicitor how long the case will take to finish.
When the case is finished and the value of the claim is agreed, the Defendant’s insurance company will provide the cheque in settlement of the case. This cheque is usually receive by your Solicitor within 2 to 3 weeks of the case finishing.
